Warranty Agreement for "The Hair Eraser"

This Warranty Agreement (the "Agreement") is made and entered into between GlowCO Pty Ltd ("Company") and the person or entity who purchased "The Hair Eraser" (the "Product") from the Company or its authorized resellers (the "Purchaser"). The Agreement sets forth the terms and conditions under which the Company agrees to provide warranty coverage for the Product.

1. Warranty Coverage:

The Company warrants that the Product will be free from defects in material and workmanship under normal use for a period of two (2) years from the date of purchase (the "Warranty Period"). The Purchaser may elect to upgrade the Warranty Period to four (4) years by selecting the extended warranty option at checkout. If the Purchaser elects to upgrade the Warranty Period, the extended warranty coverage period will commence on the date of purchase and will continue for four (4) years thereafter.

2. Warranty Claims:

To make a warranty claim, the Purchaser must contact the Company within the Warranty Period and provide the following information: (a) a description of the defect or malfunction; (b) the date of purchase of the Product; (c) the name of the authorized reseller from whom the Product was purchased; (d) the Purchaser's name, address, and telephone number; and (e) a copy of the original purchase receipt.

3. Warranty Obligations:

The Company will, at its option, either repair or replace the Product, or refund the purchase price, if the Product is found to be defective within the Warranty Period. The Company will not be responsible for any shipping or handling charges for the return of the Product or for the delivery of a replacement Product. The Company may, at its option, use new or refurbished replacement parts in fulfilling its warranty obligation. Any replacement Product will be covered by the warranty for the remainder of the original Warranty Period or ninety (90) days from the date of shipment of the replacement Product, whichever is longer.

4. Limitations and Exclusions:

The warranty provided in this Agreement is limited to the Product and does not extend to any other equipment or devices used in connection with the Product. The warranty does not cover normal wear and tear, damages caused by improper use or storage, damages caused by third-party modifications, or damages caused by an act of God. The warranty does not apply to any software or firmware included with the Product, and any such software or firmware is provided "as is" without warranty of any kind.

5. Disclaimer of Other Warranties:

EXCEPT AS EXPRESSLY SET FORTH IN THIS AGREEMENT, THE COMPANY MAKES NO WARRANTY, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

6. Limitation of Liability:

IN NO EVENT WILL THE COMPANY BE LIABLE FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7. Governing Law:

This Agreement will be governed by and construed in accordance with the laws of the State of [insert state], without giving effect to any choice of law principles.

8. Entire Agreement:

This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements and understandings, whether written or oral, relating to the Product.
